Family of construction worker who fell to death at Pearl Brewery files lawsuit

by Fidel Rodriguez, Jr.

The family of a construction worker who fell to his death at the Pearl Brewery is now filing a lawsuit.

Victor Diaz, 31, died in August and had initially been reported missing. But almost a week later, his body was found badly decomposed at the bottom of one of the Pearl's distinctive smoke stacks.

Fidel Rodriguez, the family's attorney said, to this day, the Diaz's family is still trying to find out what happened, which is why they are filing a lawsuit.

"A young man comes to San Antonio, wanting to work to help his family," said Rodriguez. "And, then for reasons that are unknown to us at this time, is not to be found until seven days later and died a horrible excruciating death."

The lawsuit was filed against two groups, Tin Star Contractors, which is a roofing contractor, and another contractor by the name of Celestino Cervantes.

"We're at a point where we feel that a lawsuit is really the best vehicle in order to have people come forth and let us know exactly what could happen or did happen," said Rodriguez. "So, we can piece all of us this together."

KSAT 12 attempted to contact Tin Star Contractors, but no one answered.

Rodriguez said in addition to finding the truth, the family is seeking damages.
