There are certain actions that defensive drivers can take in order to increase their safety. Unfortunately, there are some fatal motor vehicle accidents that even the safest of drivers cannot avoid, such as being struck while stopped at a traffic light. According to reports, a family in Texas is mourning the loss of two children after such an accident.
Police claim that a van containing three children was stopped at a red light at an intersection. The driver of a pickup truck was allegedly unable to stop in time, striking the van from the rear. The force of the collision pushed the van into another vehicle. Reports suggest that the driver of the pickup made no attempt to slow down before the collision.
An 11-year-old girl and an 8-year-old boy passed away after being transported to the hospital. A third child, a 4-year-old, remains in critical condition. Police say that while criminal charges have not been filed at this time, it is possible that they will be.
While there are many safe drivers on Texas roadways, fatal motor vehicle accidents often leave families wondering how they will cope with their loss. In addition to dealing with the emotional implications of an unexpected, preventable death, families must also cope with funeral costs and medical bills as well as other expenses. While authorities often file criminal charges, family members also have the option of seeking justice by filing a wrongful death lawsuit in a civil court. If negligence is proved, the family could receive an award of damages in accordance with state law.
