Even occasional TV watchers can point to (fictitious) shows about lawyers fighting against large corporations. These stories are always about a single lawyer or small firm taking on an industry such as auto manufacturers, big pharma or the tobacco industry. On the shows, these large corporations have plenty of financial resources, the ability to look intimidating by sending groups of lawyers and paralegals to settlement conferences and do not easily back down from a fight. They threaten to drain the financial resources of the plaintiff and offer a small compensatory payment usually accompanied by a quip about how this is better than the plaintiff deserves.
While these stories are, of course, dramatized for television, they are not completely off the mark. Large corporations do have significant resources. And they will usually attempt to coerce the plaintiff into settling as quickly and quietly as possible because it is in their best interest to do so. Settling a case out of court gives the defendant complete control over their costs. Settlement agreements may also include a confidentiality clause, which keeps the details away from the press and the public.
And proving fault in, for example, an auto product liability case is complicated. The plaintiff must demonstrate specified criteria to prove the auto manufacturer is at fault. The plaintiff can trust that if the defendant senses any weakness, it's going to hammer away at that point on the assumption that the plaintiff will simply give in and go away. That?s why it?s critical to consult with a lawyer who is experienced in dealing with large corporations and who will not be intimidated or deterred by the defendant?s tactics.
A previous blog post demonstrates that personal injury lawyer Fidel Rodriguez knows how to take on big corporations. In early March, a jury awarded his clients 124 million dollars in a product liability case they filed against Audi. During the month-long trial, Rodriguez refused to back down. Even when Audi claimed that the plaintiffs were at fault for not properly securing their child, Rodriguez fought on. If you or someone you love have been seriously injured, let attorney Fidel Rodriguez stand up for your rights.
